Two Nassau County home owners were sued by a contractor that filed a mechanic’s lien against their property and claimed it was not paid in full. The owners denied the contractor was owed any money and, in fact, claimed that the contractor performed work that was defective and deficient. The home owners hired Kushnick Pallaci to defend them against the lien foreclosure lawsuit and pursue their counterclaim against the contractor for defective work.
Managing Member Vincent T. Pallaci represented the home owners in a seventeen day trial in Nassau County Supreme Court. Judge Randy Sue Marber issued a decision in favor of the home owners, dismissing the contractor’s mechanic’s lien and its claims for non-payment in their entirety. In addition, the home owners were awarded a judgment on their counterclaim for defective work in the amount of $130,000.
